1.1. Company: Refers to Rozi Tur.Tic.Nak.Ltd.Şti.
1.2. Travel Agency: Refers to Huge Tours (the travel agency of Rozi Turizm Tic. Nak. Ltd. Şti., hereinafter referred to as the “Travel Agency”).
1.3. Website / Site: Refers to the Company’s website “gidiyorum”.
1.4. Member: Refers to individuals who register on the Site by accepting the terms and conditions specified in this agreement in order to benefit from special and general campaigns, promotions, advertisements, and similar services mediated by the Company’s website “gidiyorum”.
1.5. User: Refers to individuals who purchase services mediated by the Company’s website “gidiyorum” and/or complete reservation transactions without registering on the Site.
1.6. Call Center: Refers to the call center with the number 0850 346 1 346, which provides support services to Users and/or Members regarding services mediated through the Website, after obtaining such services from the relevant service providers.
1.7. Supplier: Refers to national and international airline companies, hotels, hotel suppliers, and all current and future service providers communicated to the Site by the Service Provider, including but not limited to airlines, hotels, and/or suppliers that ensure the fulfillment of services.
2.1. This Membership Agreement and Terms of Use explain the rules to be followed and the membership conditions while using “gidiyorum” (hereinafter referred to as the “Website/Site”).
2.2. “gidiyorum” reserves the right to change any kind of service, product, site usage rules, and information available on this Site and its extensions, to reorganize the Site, and to suspend publication without prior notice. Changes become effective upon publication on the Site. By using or accessing the Site, Members are deemed to have accepted these changes.
2.3. Huge Tours – Rozi Tur.Tic.Nak.Ltd.Şti., with TÜRSAB registration number A-5116, provides intermediary services for all tourism services offered on the Site, including hotel reservations, flight reservations, scheduled and charter flight tickets, and accommodation sales.
3.1. In order to obtain “Member” status, the person wishing to become a Member must complete the Membership Form on the Site with accurate information as requested, the membership application must be evaluated and approved by “gidiyorum,” and if the applicant is a natural person, they must be at least 18 years old.
3.2. The Member accepts, declares, and undertakes that they are responsible for ensuring the security of their passwords. The Member agrees not to share their username and password with others, is responsible for safeguarding them, acknowledges that “gidiyorum,” the Company, and the Travel Agency shall not be liable for any damages arising from passwords falling into the hands of third parties, and accepts that misuse and/or use by another person will result in the loss of all membership rights, withdrawal of all related rights and benefits, and the application of any necessary measures.
3.3. The Member also accepts, declares, and undertakes that they may only benefit from the rights and opportunities provided by “gidiyorum” as long as their membership continues, and that they cannot benefit from acquired rights once membership is terminated.
3.4. If a violation of the “gidiyorum” Membership Agreement and Terms of Use by the Member is detected, or if a complaint regarding such violations is received, “gidiyorum” may block the Member’s access to the Website and terminate membership without prior notice. The Member accepts that membership will continue only as long as all Terms of Use are fulfilled. In such a case, all liabilities arising therefrom, and all claims, demands, and/or payments that may be asserted against “gidiyorum,” the Company, and the Travel Agency by third parties and/or competent authorities, shall be subject to recourse by the Company, “gidiyorum,” and the Travel Agency against the relevant Member, together with ancillary claims.
4.1.1. The User/Member accepts, declares, and undertakes that they are responsible for the content and accuracy of passenger information entered on the Site, that no changes can be made after entering such information into the system, and that all responsibility for any resulting damage belongs to them.
4.1.2. The User/Member accepts, declares, and undertakes that “gidiyorum,” the Company, and the Travel Agency cannot be held responsible for disputes, damages, and/or claims that may arise between Supplier companies and the User/Member regarding services offered through the Site, and that the sole responsible party is the actual provider of the relevant service.
4.1.3. The User/Member accepts, declares, and undertakes that “gidiyorum” makes no commitment regarding the accuracy, completeness, or uninterrupted availability of content obtained from suppliers and/or intermediary institutions, and that “gidiyorum,” the Company, and the Travel Agency are not responsible for damages arising from connection interruptions, communication disruptions, or similar issues caused by internet infrastructure and telecommunication providers.
4.1.4. The User/Member accepts, declares, and undertakes that although “gidiyorum” exercises utmost care regarding the accuracy of information obtained from suppliers and/or intermediary institutions and published on the Website, “gidiyorum,” the Company, and the Travel Agency cannot be held responsible if the purchased or requested service does not match the specified qualifications or availability.
4.1.5. The User/Member accepts that products available on the Website are organized by the relevant suppliers and/or intermediary institutions under their own responsibility, and that the rules and conditions of the relevant supplier apply regarding the content on the Site. “gidiyorum” acts solely as an intermediary between the User/Member and the Supplier.
4.1.6. The User/Member accepts, declares, and undertakes that “gidiyorum,” the Company, and the Travel Agency cannot be held responsible for any disruptions that may occur in services mediated through the Site.
4.1.7. The User/Member accepts, declares, and undertakes that “gidiyorum,” the Company, and the Travel Agency shall not be held responsible for disruptions arising from reasons beyond their control, such as political events, strikes, minimum passenger requirements, changes in international relations, public movements, weather conditions, natural disasters, epidemics, and technical problems in services provided through the Site and Call Center.
4.1.8. When purchasing a product or service through the Website, the User/Member must enter their first and last name exactly as written on their official identification document, as well as their email address, credit or debit card number, card expiration date, and phone number. (In this context, personal data provided by Members is protected as stated in the Clarification Text and Personal Data Protection Policy available on the “gidiyorum” website.) The User/Member accepts, declares, and undertakes that “gidiyorum,” the Company, and the Travel Agency bear no responsibility for failure to provide, incomplete provision, or incorrect provision of such information. The Company will send electronic communications/SMS to the contact details entered by the User/Member during the transaction in order to provide information regarding the purchased service.
4.1.9. All purchases made through the Site must be paid by credit card or debit card. The User/Member accepts, declares, and undertakes that the bank or credit card used for payment must be a member of the 3D Secure system. The 3D Secure system is designed to protect the cardholder against unauthorized use of the card by third parties and to provide security against possible risks. The User/Member accepts, declares, and undertakes that they bear sole responsibility for purchases made through the 3D Secure system on the Site, and that they cannot dispute charges related to payments completed via 3D Secure; even if they do so, such objections shall be invalid due to full verification by the 3D Secure system.
4.1.10. Information provided during membership and reservation transactions is protected by the SSL security system. Customer information cannot be viewed by third parties, nor can third parties intervene. This information may only be used in connection with the sales process and in accordance with your instructions. It is not shown to or transferred to third parties and is only transmitted to your relevant bank.
4.1.11. If, after the performance of the service, the relevant bank or financial institution fails to pay the service fee to the Site due to a claim that the credit card used by the Member for payment was unlawfully and illegally used by unauthorized persons for reasons not caused by the Site’s fault, the Member shall be responsible for the disputed service fee and all damages, together with legal interest accruing from the date of purchase.
4.1.12. A reservation made or a service purchased through the Site cannot be transferred to another person, and name changes cannot be made.
5.1. “gidiyorum” may unilaterally amend this agreement at any time it deems appropriate by publishing the changes on the Site, entirely at its own discretion. The amended provisions of this agreement shall become effective on the date they are announced, while the remaining provisions shall remain in force and continue to produce legal effect.
5.2. The invalidity, unenforceability, or loss of binding effect of any provision of this Membership Agreement and Terms of Use shall not affect the validity of the remaining provisions.
5.3. This Membership Agreement and Terms of Use shall be governed by Turkish law, and in the event of disputes arising between the parties and in all legal transactions, the Courts and Enforcement Offices of Muğla shall have jurisdiction.
5.4. By using the Website, the MEMBER accepts, declares, and undertakes that they have read and accepted this Membership Agreement and the content of the Terms of Use in advance and that they shall comply with them.
